J&K High Court Issues New Directive on Marriage Protection Petitions

Srinagar, March 24, 2025 – The High Court of Jammu & Kashmir and Ladakh has issued a new directive mandating the submission of an affidavit detailing the marital status of petitioners in marriage protection cases.

As per Circular No. 113-RS, issued by the Office of the Registrar Judicial, Srinagar, petitioners seeking protection of their marriage must explicitly declare whether they have previously solemnized any marriage. The circular follows the Hon’ble Court’s direction dated December 18, 2024, in WP(C) No. 2862/2024 (Parveena Bano & Anr. vs. UT of J&K & Ors.).

The directive warns that any marriage protection petition lacking this affidavit will not be registered. The Assistant Registrar of the Institution/Filing Section has been instructed to ensure strict compliance. The circular has also been made available on the official website of the High Court and displayed on notice boards.

This move is seen as an effort to bring more transparency and accountability to marriage-related petitions in the region.
