Srinagar, March 25, 2025 – The High Court of Jammu & Kashmir and Ladakh has dismissed a petition seeking ownership rights under the now-defunct Roshni Act..
Justice Rajnesh Oswal, while hearing OWP No. 1417/2018 filed by Hafiza Akther and others, ruled that since the Roshni Act has been declared ultra vires, the relief sought by the petitioners could not be granted. As a result, the petition was dismissed.
The case was represented by Mr. Bikramdeep Singh, Dy. AG, along with Advocate Nowbhar Khan for the respondents, while no legal counsel appeared for the petitioners during the proceedings.
The Roshni Act, officially known as the Jammu and Kashmir State Lands (Vesting of Ownership to the Occupants) Act, 2001, was scrapped after being declared unconstitutional, leading to the annulment of land allotments made under it. The ruling further strengthens the legal position against claims seeking ownership under the repealed law.
The order was passed on March 18, 2025, at the Srinagar bench of the High Court.
